Sidetrack (the “Site”) is operated and owned by Selgo Imagen y Diseño S.A. de C.V., with address located at Ejercito Nacional 425 Piso 9, 901 Col. Chapultepec Morales, Granada, Miguel Hidalgo, Ciudad de México 11520 (“Sidetrack”). One of Sidetrack’s purposes is to protect the Personal Data provided by its Users.
INFORMATION COLLECTED BY SIDETRACK THROUGH THE SITE
To register on the Site, the User may fill out a registration form or log in through his/her
Facebook, Twitter, Linkedin, Vimeo, Instagram or Google + account; in doing so, Sidetrack will
obtain the following Personal Data (subject to the User’s privacy settings on his/her public
social networking profile): full name, date of birth or age range, e-mail address, gender, country
and state, occupation, user ID, profile picture, language, education and employment, tastes and
interests.
Sidetrack will not collect sensitive data the improper use of which could result in discrimination
or involve a serious risk to the Personal Data Holder. Sensitive data is considered to be data
that may reveal aspects such as racial or ethnic origin, health status, genetic information,
religious, philosophical and moral beliefs, trade union membership, political opinions and sexual
preference.
PURPOSE Sidetrack collects the Personal Data registered on the Site by the Holder with the
intention of offering customized content, sending him/her news, keeping him/her informed
about Sidetrack events/information related to his/her interests, pre-sales announcements,
discounts and changes to the Privacy Notice; as well as to offer him/her, according to
availability, access to exclusive promotions and content (trend reports, videos, launches,
downloads).
By providing the Personal Data through our Site, the Holder agrees to know and agree to the
terms of this Privacy Notice and expressly consents the processing of his/her Personal Data as
provided herein.
PRIVACY AND SECURITY OF YOUR INFORMATION
Personal Data may be processed by Sidetrack, either by itself or through companies expressly
hired to do so, and the Services of the Site are operated in the United Mexican States. If the
Holder is outside the United Mexican States, please note that the information we collect will be
processed in the country mentioned above.
Sidetrack implements reasonable security measures to protect your information both online and
offline and uses available technology to protect the Information provided by Users of the Site.
The Site contains hyperlinks or hypertext “links”, banners, buttons and search tools that when
clicked on or used by Users lead to other sites owned by third parties, so that the Information
that the User provides through those sites is not covered or contemplated by this Privacy Notice
and its management or use is not responsibility of Sidetrack, therefore, we recommend that our
Users verify the Privacy Notices displayed at, or applicable to such sites or third party portals.
The information Sidetrack collects through the Site may be used for commercial purposes, such
as providing statistical data (e.g., 50% of our users live on Mexico City) to potential advertisers,
sending advertising to Users in accordance with their specific interests, and conducting
marketing research or promotions that Sidetrack deems appropriate. Sidetrack may also
disclose Information when required by law and/or competent authority.
Sidetrack does not transfer to any third party the Personal Data it collects on the Site.
Sidetrack reserves the right to transfer the Information to any of its affiliates or subsidiaries in
terms of Article 37, section III of the Law.
ACCESS, RECTIFICATION, CANCELLATION AND OPPOSITION – “ARCO” RIGHTS
The User enters his/her Personal Data in the REGISTRATION section of
www.wearesidetrack.com.
If you wish to rectify any data, you must send an e-mail to
info@sidetrack.agency with the following information: the e-mail address with which you
registered, the site where you registered, an electronic copy of any document that proves your
identity (voter’s credential, federal taxpayers’ registry, valid passport), a clear and precise
description of the Personal Data regarding which you seek to exercise your rights, and mention
the amendments to be made and/or the limitations to the use of the Data provided.
The User’s request will be followed up and, if valid, within no more than 20 business days,
his/her subscription will be deleted and his/her Personal Data will not be used for any purpose.
The requests will not be valid when: (1) the requesting party is not the owner of the Personal
Data or the legal representative is not duly authorized to do so, (2) the Personal Data of the
requesting party is not found in the Sidetrack database,
(3) the rights of a third party are
breached, (4) there is a legal impediment or the resolution by a competent authority restricting
access to the Personal Data, or preventing the rectification, cancellation or opposition thereof, (5) when the rectification, cancellation or opposition has been previously made.
As a User of the Site, you hereby expressly authorize Sidetrack (as defined in the Terms and
Conditions of the Site) to contact you via email and to use or disclose, on the terms described
herein, the information provided when you register on the Site. In the event of opposition, the
User may do so automatically from any mailing received from Sidetrack by clicking on the
unsubscribe link (inserted at the bottom of the emails).
Due to the above, the User may oppose to: (i) processing of his/her data, (ii) receiving
information via email. In this case, your subscription will be cancelled and your data will be
removed from the database to avoid contact of any kind.
USE OF COOKIES
A cookie is a small piece of information sent by a website and stored in the User’s browser in
order for the Site to check the User’s activity.
This Site will store a cookie in the User’s browser, at the time of entry and login, which will
contain information regarding his/her access account, but not his/her personal information.
The purpose is to report the User’s login status on the Site and his/her navigation on the Site in
order to provide him/her with a customized experience, as well as to send him/her customized
Site advertisements through remarketing. The User may disable cookies from his/her browser
when he/she wishes; however, it is important to note that he/she will not be able to participate
in some content on this Site that requires such a cookie to authenticate him/her as a User with
an active session. To disable cookies, the User must access the Privacy option of his/her
browser (located in Internet Options, Settings or Preferences) and remove them by selecting the
appropriate box.
CHANGES TO THE PRIVACY NOTICE
Sidetrack will notify any changes in the Privacy Notice to the email that the User used to
register, provided that it will not be Sidetrack’s responsibility if such email was deleted.
